1. INTRODUCTION

These Terms and Conditions ("Terms") govern your access to and use of the website located at convergenmedia.com and all associated landing pages, workshops, training programs, and digital products offered by Convergen Media LTD ("we", "us", "our", "the Company").

By accessing our website, registering for a free workshop, or purchasing any of our programs, you ("you", "the participant", "the student", "the customer") agree to be bound by these Terms in full. If you do not agree with any part of these Terms, you must not access or use our services.

These Terms are governed by the laws of England and Wales and are subject to the jurisdiction of the courts of England and Wales.

2. DEFINITIONS

In these Terms:

  • "Program" refers to Funnel Hackademy™, our 12-week online training course

  • "Workshop" refers to any free or paid live event, webinar, or training session offered by us

  • "Content" refers to all videos, PDFs, templates, scripts, emails, and materials provided within the Program or Workshop

  • "Platform" refers to the Skool community where Program content is hosted

  • "Participant" refers to anyone who registers for a free Workshop

  • "Student" refers to anyone who purchases the Program

  • "Services" refers collectively to all workshops, programs, and digital products we offer

3. FREE WORKSHOP REGISTRATION

3.1 Eligibility

Our free workshops are open to anyone aged 18 or over. By registering, you confirm you meet this age requirement.

3.2 What Registration Includes

When you register for a free workshop, you will receive:

  • Email confirmation of your registration

  • Daily reminder emails with joining instructions

  • Access to the live session(s) at the scheduled time

  • Access to the replay for a limited period (typically 24-48 hours after each session, unless otherwise stated)

3.3 No Guarantee of Results

Attendance at a free workshop does not guarantee any specific outcome, income, or result. The content is provided for educational purposes only.

3.4 Recording and Replay

We reserve the right to record our workshops. By attending, you acknowledge that the session may be recorded and that replays may be made available to other participants.

3.5 Changes to Schedule

We reserve the right to reschedule, cancel, or modify any workshop at any time. Where possible, we will provide advance notice by email. In the event of cancellation, registered participants will be notified.

4. PURCHASE OF FUNNEL HACKADEMY PROGRAM

4.1 What You Are Purchasing

When you purchase Funnel Hackademy™, you receive:

  • Lifetime access to the course content hosted on Skool

  • Access to all current modules (150+ video lessons)

  • Access to the Client Acquisition Module from Day 1

  • Access to the AI Amplifier Bonus Module (Weeks 13-16)

  • 50+ templates and resources

  • Participation in the private Skool community

  • Live implementation calls (Cohort 1 only — see Section 4.5)

  • All future updates to the program content

4.2 Pricing

Option 1 — One-Time Payment: $1,997 USD

Option 2 — Payment Plan: $798 USD × 3 monthly instalments (total: $2,394 USD)

All prices are displayed in US Dollars. The amount charged to your payment method may vary slightly due to currency conversion rates if you are purchasing from outside the United States.

4.3 Payment Processing

All payments are processed securely by Stripe. We do not store your card details. By purchasing, you agree to Stripe's Terms of Service at stripe.com/gb/legal.

You authorise us to charge the full amount (one-time) or the first instalment (payment plan) at the time of purchase, and subsequent instalments on a monthly basis thereafter.

4.4 Payment Plan Obligations

If you select the payment plan option:

  • You agree to pay all three instalments in full

  • Instalments will be charged automatically to your payment method on a monthly basis

  • Failure to complete all payments does not entitle you to a refund of amounts already paid

  • If an instalment payment fails, we will attempt to retry the payment. After two failed attempts, access to the program may be suspended until payment is brought up to date

  • You may not cancel your payment plan after the 30-day refund period has expired (see Section 5)

4.5 Cohort 1 Live Calls

Live implementation calls are available exclusively to Cohort 1 participants. These calls are scheduled over a 12-week period following the cohort start date. Details will be communicated upon enrolment. Live calls are not guaranteed to be available for future cohorts.

4.6 Enrolment Limits

We reserve the right to limit enrolment to any cohort. Enrolment is on a first-come, first-served basis. Payment in full (or first instalment) constitutes confirmed enrolment.

5. REFUND POLICY & 30-DAY MONEY-BACK GUARANTEE

5.1 Our Guarantee

We offer a 30-day money-back guarantee on the Funnel Hackademy program. If you are not satisfied with the program for any reason, you may request a full refund within 30 days of your original purchase date.

5.2 How to Request a Refund

To request a refund, you must:

  1. Email us at [email protected] within 30 days of your purchase date

  2. Use the subject line: "Refund Request — Funnel Hackademy"

  3. Include your full name and the email address used at purchase

We aim to process all refund requests within 5 business days of receipt. Refunds will be issued to the original payment method via Stripe and may take 5–10 business days to appear on your statement.

5.3 Refund Conditions

  • Refunds are only available within 30 days of the original purchase date

  • Refund requests made after 30 days will not be honoured

  • Refunds apply to the full purchase price for one-time payments

  • For payment plan customers requesting a refund within 30 days, only the first instalment will be refunded and remaining instalments will be cancelled

  • We reserve the right to decline refund requests where we reasonably believe the program is being accessed and exploited in bad faith (e.g. downloading all materials and immediately requesting a refund)

5.4 Your Statutory Rights

Nothing in these Terms affects your statutory rights as a consumer under UK law, including rights under the Consumer Rights Act 2015 and the Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013.

Under the Consumer Contracts Regulations, you have the right to cancel a digital purchase within 14 days of purchase. However, by accessing the course content after purchase, you expressly consent to immediate delivery and acknowledge that your right to cancel under these regulations is waived once you begin accessing the program. Our 30-day guarantee is provided as a more generous alternative.

6. PROGRAM ACCESS AND DELIVERY

6.1 Access

Upon successful payment, you will receive an email with instructions to access the program on Skool. It is your responsibility to ensure you can receive emails from [email protected]. Check your spam folder if you do not receive your access email within 24 hours.

6.2 Lifetime Access

"Lifetime access" means access for as long as Funnel Hackademy™ remains active as a program. We intend to maintain the program indefinitely, but in the unlikely event that we discontinue it, we will provide at least 90 days' notice to active students.

6.3 Updates

We periodically update the program content to reflect changes in platforms, tools, and best practices. Updates are included at no additional cost. We do not guarantee that specific tools (such as GoHighLevel or Systeme.io) will remain part of the curriculum if those platforms significantly change or cease to exist.

6.4 Technical Requirements

Access to the program requires a stable internet connection, a modern web browser, and a Skool account. You are responsible for ensuring your device meets these requirements. We are not responsible for access issues caused by your device, browser, or internet connection.

6.5 Account Sharing

Your access is personal to you and may not be shared with, transferred to, or used by any other person. If we detect that account credentials are being shared, we reserve the right to terminate access without refund.

7. ACCEPTABLE USE

7.1 SMS Service Description

By providing your mobile phone number and agreeing to receive SMS (text message) communications from us, you expressly consent to receive text messages from Convergen Media LTD for the following purposes:

Transactional and Service Messages:

  • Workshop registration confirmations

  • Daily workshop reminders with Zoom joining links

  • Time-sensitive updates about scheduled sessions

  • Payment confirmations and receipts

  • Account access and technical support communications

  • Programme delivery and course access instructions

Marketing and Promotional Messages:

  • Information about Funnel Hackademy programmes and offerings

  • Limited-time promotional offers and discounts

  • Educational content and training opportunities

  • Updates about new courses, modules, or features

7.2 Message Frequency

Message frequency varies depending on your engagement with our services:

During Active Workshop Periods (5-Day Events):

You may receive up to 2-3 SMS messages per day, including advance reminders (sent 24 hours prior) and immediate pre-session reminders (sent 2 hours prior to live sessions).

General Marketing Communications:

You may receive approximately 1-4 SMS messages per month containing promotional offers, programme updates, and educational content.

Time-Sensitive or Urgent Communications:

Occasionally, we may send additional messages outside the above frequency if there are urgent changes to scheduled events, technical issues requiring immediate attention, or time-sensitive opportunities.

7.3 Opt-Out and Unsubscribe

You may opt out of receiving SMS messages at any time using any of the following methods:

Reply STOP:

Text the word STOP (or UNSUBSCRIBE) to any SMS message you receive from us. You will receive a confirmation message confirming your unsubscription. After opting out, you will no longer receive any SMS messages from us unless you explicitly re-subscribe.

Reply HELP:

Text the word HELP to any SMS message to receive information about the service, including opt-out instructions and support contact details.

Email Request:

Send an email to [email protected] with the subject line "SMS Opt-Out" and include the mobile phone number you wish to remove.

Reply START:

If you have previously opted out and wish to re-subscribe, text the word START to re-enable SMS messages.

Important: Opting out of marketing SMS messages will not affect transactional messages related to purchases you have made (such as payment confirmations or access instructions). However, you will no longer receive workshop reminders or promotional content.

7.4 Message and Data Rates

Standard messaging and data rates may apply depending on your mobile phone plan and carrier. We do not charge you for sending or receiving SMS messages; however, your mobile carrier may charge you according to your plan's text messaging rates.

If you are on a pay-as-you-go plan or have limited text messaging included in your plan, you should verify the cost of receiving text messages with your mobile carrier before opting in.

We are not responsible for any charges incurred from your mobile carrier for receiving SMS messages from us.

7.5 Supported Carriers

Our SMS service is supported by major mobile carriers in the UK and internationally, including but not limited to:

  • UK Carriers: EE, O2, Vodafone, Three, Tesco Mobile, Virgin Mobile, giffgaff

  • US Carriers: AT&T, T-Mobile, Verizon Wireless, Sprint, U.S. Cellular, Boost Mobile, Cricket Wireless, MetroPCS

  • International Carriers: Compatible with most major carriers worldwide

7.6 Carrier and Technical Limitations

Carrier Liability Disclaimer:

We are not responsible for any delays, failures, or errors in the delivery of SMS messages caused by your mobile carrier, network congestion, technical issues, or any other factors beyond our reasonable control.

Service Availability:

SMS service availability depends on your mobile carrier's network coverage and your device's compatibility. We do not guarantee that SMS messages will be delivered to all mobile devices or carriers at all times.

Delivery Delays:

SMS messages are typically delivered within seconds to minutes, but delivery times may vary based on network conditions, carrier processing times, and device availability. We are not responsible for delays in message delivery.

Device Compatibility:

You are responsible for ensuring that your mobile device is capable of receiving SMS text messages. Some older devices or certain device settings may prevent SMS delivery.

Network Issues:

If your mobile device is turned off, out of service area, or otherwise unable to receive messages at the time of transmission, we are not liable for non-delivery. Messages may not be re-sent once the delivery window has passed.

7.7 Privacy and Data Usage

Your mobile phone number and SMS engagement data are collected and processed in accordance with our Privacy Policy (available at convergenmedia.com/privacy). By opting in to SMS messages, you acknowledge that you have read and agree to our Privacy Policy.

Third-Party Service Providers:

We use GoHighLevel as our SMS service provider to deliver text messages. Your mobile number may be shared with GoHighLevel solely for the purpose of message delivery. GoHighLevel is contractually obligated to protect your data in accordance with applicable privacy laws.

No Sale of Mobile Numbers:

We will never sell, rent, lease, trade, or otherwise share your mobile phone number with third parties for their own marketing purposes.

7.8 User Responsibilities

By providing your mobile phone number and consenting to receive SMS messages, you represent and warrant that:

  • You are the owner or authorised user of the mobile phone number you provide

  • You are 18 years of age or older

  • You have the authority to consent to receive SMS messages at the provided number

  • The mobile phone number you provide is accurate and currently active

  • You will promptly notify us if your mobile phone number changes

You agree not to:

  • Provide a mobile phone number that you do not own or are not authorised to use

  • Forward or share SMS messages containing time-sensitive links (such as workshop Zoom links) in a manner that violates these Terms

  • Use automated systems to interact with our SMS service (e.g. auto-reply bots)

7.9 Changes to SMS Terms

We reserve the right to modify or discontinue our SMS service at any time, with or without notice. We may also update these SMS Terms from time to time. Continued receipt of SMS messages after such changes constitutes your acceptance of the updated terms.

7.10 Legal Compliance

Our SMS service complies with:

  • UK GDPR (General Data Protection Regulation)

  • UK PECR (Privacy and Electronic Communications Regulations)

  • US TCPA (Telephone Consumer Protection Act), where applicable

  • CTIA (Cellular Telecommunications Industry Association) guidelines

By opting in to SMS messages, you acknowledge that your consent is voluntary and that you understand you are not required to consent to receive SMS messages as a condition of purchasing any goods or services from us.

8. INTELLECTUAL PROPERTY

By accessing our workshops and programs, you agree that you will:

  • Use the program content for your own personal and professional development only

  • Not reproduce, copy, distribute, sell, or share any course materials without our express written permission

  • Not record live sessions (whether workshop or coaching calls) without our express written permission

  • Not use our content to create competing products or programs

  • Behave respectfully toward other community members within the Skool platform and in any live sessions

  • Not post spam, offensive content, or unsolicited promotions in the Skool community

We reserve the right to remove any participant from the community and revoke access without refund if these terms are violated.

9. INTELLECTUAL PROPERTY

9.1 Our Content

All content provided within Funnel Hackademy™ — including but not limited to video lessons, PDFs, templates, scripts, email copy, workbooks, and community posts made by us — is the intellectual property of Convergen Media LTD and is protected by copyright.

"Funnel Hackademy™" and "Convergen Media LTD" are trading names of the company. Unauthorised use of these names or logos is prohibited.

9.2 Permitted Use

Upon purchase, you are granted a limited, non-exclusive, non-transferable licence to access and use the course materials for your own personal and professional development only.

9.3 Prohibited Use

You may not:

  • Reproduce or copy materials for distribution (free or paid)

  • Create derivative works based on our content

  • Share login credentials or grant others access to your account

  • Use our templates, scripts, or frameworks to create and sell competing educational programs

  • Screenshot, download, or share video content without written permission

Violation of these terms may result in immediate access termination and legal action.

9.4 Your Content

Any materials, funnels, or work you create as part of the program remain your intellectual property. By sharing work in the Skool community, you grant us a non-exclusive licence to reference or showcase your work for promotional purposes (e.g. student success stories), unless you ask us not to.

10. DISCLAIMERS AND EARNINGS DISCLAIMER

10.1 Educational Purpose

Funnel Hackademy™ is an educational program. The information provided is for educational purposes only and does not constitute professional financial, legal, or business advice.

10.2 Earnings Disclaimer

Results are not guaranteed. The income and revenue figures mentioned in our marketing materials — including but not limited to $7K-$9K/month, $2,500-$5,000 per client, and client case studies — represent our own personal results or the results of specific clients. These results are not typical and are not a guarantee that you will achieve the same or similar outcomes.

Your results will depend entirely on factors including but not limited to:

  • Your individual effort, skills, and commitment

  • Your prior experience and background

  • The time you invest in the program

  • The economic conditions of your market

  • Your ability to attract and serve clients

  • External factors beyond our control

Some students will earn more, some will earn less, and some may earn nothing. We make no promise that you will earn any specific amount by completing this program.

10.3 No Guarantee of Employment or Clients

Completing Funnel Hackademy™ does not guarantee employment, clients, income, or any specific career outcome. Success requires consistent implementation of the skills taught.

10.4 Platform Availability

Our program teaches skills using third-party platforms including GoHighLevel, Systeme.io, Figma, and ClickFunnels. We are not affiliated with, endorsed by, or responsible for these platforms. Prices, features, and availability of third-party platforms are subject to change at any time. We are not responsible for changes to these platforms that may affect the applicability of our training.

11. LIMITATION OF LIABILITY

11.1 General Limitation

To the fullest extent permitted by law, Convergen Media LTD shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of or inability to use our services, including but not limited to lost profits, lost revenue, or loss of data.

11.2 Maximum Liability

Our total liability to you for any claim arising out of or in connection with these Terms shall not exceed the total amount you paid to us for the program.

11.3 Third-Party Platforms

We are not responsible for any losses, damages, or issues arising from your use of third-party platforms referenced in the program (GoHighLevel, Systeme.io, Stripe, Skool, Zoom, Figma, etc.). Your use of those platforms is subject to their own terms and conditions.

12. COMMUNITY GUIDELINES (SKOOL)

As part of your enrolment, you gain access to our private Skool community. By joining, you agree to:

  • Treat all members and instructors with respect and professionalism

  • Not post spam, irrelevant promotions, or unsolicited offers

  • Not share personal contact information of other members without their consent

  • Not harass, threaten, or intimidate any member

  • Contribute positively to discussions and help create a supportive learning environment

We reserve the right to remove any member from the community for violations of these guidelines, without refund, at our sole discretion.

13. PRIVACY

Your use of our services is also governed by our Privacy Policy, available at convergenmedia.com, which is incorporated into these Terms by reference. By using our services, you acknowledge that you have read and agree to our Privacy Policy.

14. CHANGES TO THESE TERMS

We reserve the right to update or modify these Terms at any time. Changes will be effective immediately upon posting to our website. Continued use of our services following any changes constitutes your acceptance of the revised Terms. We will notify active students of material changes by email.

15. SEVERABILITY

If any provision of these Terms is found to be invalid, unlawful, or unenforceable by a court of competent jurisdiction, that provision shall be deemed severed from the rest of these Terms, which shall continue in full force and effect.

16. ENTIRE AGREEMENT

These Terms, together with our Privacy Policy and any other agreements explicitly referenced herein, constitute the entire agreement between you and Convergen Media LTD with respect to the subject matter hereof and supersede all prior agreements, representations, and understandings.

17. GOVERNING LAW AND JURISDICTION

These Terms are governed by and construed in accordance with the laws of England and Wales. Any disputes arising out of or in connection with these Terms shall be subject to the exclusive jurisdiction of the courts of England and Wales.
